Terms of Service

The legal terms covering your use of the Babaru website, the Babaru app, and the Babaru device. Plain English, no boilerplate.

1. Agreement

By using babaru.co, the Babaru app, or your Babaru device, you agree to these terms. If you don't agree, please don't use them. These terms form a binding contract between you and Babaru, Inc.

2. Who can use Babaru

You must be at least 13 years old (16 in the EU/UK) to use the Babaru app. The device itself is rated for ages 8+ with adult supervision. If you're buying for someone under 13, the adult owner of the paired phone is responsible for the account.

3. Orders, payment, and shipping

Placing a pre-order is an offer to buy. We accept that offer when we charge your payment method and send a confirmation email. Price, ship date, and product specifications are as shown on the product page at the time of order. See shipping & returns for full details.

4. License to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Babaru app on devices you own or control, for the purpose of using your Babaru device. You may not reverse engineer the app, attempt to extract the on-device model, or use the app with hardware other than a genuine Babaru.

5. Your content

Anything you say to Babaru, and anything Babaru remembers about you, stays on your device. We don't have access to it. You own it. We make no claim to it.

If you share content with us (support emails, reviews, social posts tagging Babaru), you grant us a non-exclusive license to use it for the purpose you shared it (responding to support, promotion if you tagged us publicly).

We may release updates to the Babaru app and to your device's firmware. Some updates may add, modify, or remove features. We'll communicate material changes in advance where practical.

8. Warranty

The Babaru device comes with a 2-year limited warranty. See the warranty page for what's covered. Beyond that warranty, our products and services are provided "as is," to the extent permitted by applicable law. This does not affect your statutory consumer rights.

9. Limitation of liability

To the maximum extent permitted by applicable law, Babaru, Inc. is not liable for indirect, incidental, special, or consequential damages, or for any loss of profits, revenue, or data. Our total liability for any claim relating to your Babaru is limited to the amount you paid for the product. Nothing in this section limits liability we are not legally permitted to disclaim — including liability for death, personal injury caused by negligence, or fraud.

10. Indemnification

You agree to indemnify Babaru, Inc. for any third-party claim arising from your breach of these terms or your misuse of our products.

11. Termination

We may suspend or terminate your access to the app or our services if you materially breach these terms. You may stop using Babaru at any time — just delete the app and, if you wish, factory reset the device.

12. Governing law & disputes

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, unless mandatory law in your country of residence provides otherwise.

13. Changes

We may update these terms from time to time. We'll post the new version here and update the date. Material changes will be emailed to anyone with an active order or account.
